J&K Ease of Doing Business Act 2026: Self-Declaration, Deemed Approval and No Duplicate Licences

The Jammu and Kashmir Government has notified a series of reforms under the Jammu and Kashmir Ease of Doing Business (EoDB) Act, 2026. The aim is to simplify how enterprises are set up and run, remove duplicate licences and cut unnecessary departmental clearances and inspections. The three orders, issued by the General Administration Department, follow the publication of the Act in the Official Gazette on October 1, 2026.

Why were these reforms needed?

According to the government order, an enterprise, especially one coming up in an industrial area or cluster, has had to obtain approvals from many departments and agencies. These cover land, building plans, fire safety, electricity, water supply, effluent disposal, environment, factory licensing and municipal matters.

Each department follows its own checklist, timelines, portal and documentation requirements, which often causes delays. There has also been no single authority responsible for guiding an enterprise from project planning to the start of production. The new framework is designed to fix this.

Key reforms at a glance

1. Executive Committee as Single Nodal Agency

The Executive Committee under Section 8 of the EoDB Act will act as the Single Nodal Agency for all pre-establishment, construction, utility connection and operational approvals across J&K. This includes enterprises in notified industrial areas, industrial parks and clusters. It will coordinate with District Empowered Committees to make sure approvals are granted within the prescribed timelines.

2. No duplicate licences (Section 24)

All departments, Urban Local Bodies and other competent authorities must stop demanding duplicate licences, registrations and fees. Certain valid registrations will be treated as sufficient compliance for the activities they cover:

  • Food Safety and Standards Act, 2006: a valid registration or licence is enough for the food business activity and premises. No separate municipal or local trade licence, health trade licence, eating house licence, restaurant licence or hotel licence is needed for the same activity.
  • GST registration (Central or J&K GST law): enough to dispense with a separate municipal or local trade licence.
  • MSME Development Act, 2006 registrations and approvals are covered for the purposes of Section 24.
  • Labour codes: the Occupational Safety, Health and Working Conditions Code, 2020; the Code on Social Security, 2020; the Code on Wages, 2019; and the Industrial Relations Code, 2020.

3. Self-declaration and the Certificate of In-Principle Approval (CIPA)

Eligible enterprises can now begin establishing their units by submitting a Declaration of Intent to the District Empowered Committee. The Committee issues a Certificate of In-Principle Approval (CIPA) under the supervision of the Executive Committee.

Feature Provision
CIPA validity3 years
Time to issue (approved industrial parks)3 working days
Time to issue (outside industrial parks)30 days
If the committee does not decide in timeDeemed approval; certificate can be downloaded from the designated portal
What the CIPA allowsEstablish the unit, build and begin operations while obtaining regular approvals within the prescribed period

4. Protection from routine inspections

Enterprises with a CIPA get protection from routine inspections for three years from the date of grant. Inspections are still allowed for serious complaints and under the conditions in Sections 13 and 14 of the Act.

5. Self-certification, third-party certification and the Negative List

The Act provides for self-certification and third-party certification for specified activities and approvals, reducing repeated departmental verification. Enterprises can operate from any location unless it is specifically prohibited under the Negative List in Schedule II of the Act.

What it means for entrepreneurs and investors

  • Faster start-up: A time-bound path from project idea to production, with deemed approval as a backstop.
  • Lower compliance burden: One valid registration, such as FSSAI or GST, can replace several local licences.
  • Fewer inspections: Three years of protection from routine inspections gives units room to stabilise.
  • Clearer accountability: One nodal agency instead of many departments.

The real test will be implementation: how quickly District Empowered Committees start functioning, and how smoothly the designated portal works.

Frequently asked questions

What is the J&K Ease of Doing Business Act, 2026?

It is a law that simplifies setting up and running enterprises in Jammu and Kashmir by removing duplicate licences, enabling self-declaration and reducing inspections.

What is a Certificate of In-Principle Approval (CIPA)?

It is a certificate issued on a self-declared Declaration of Intent. It lets an enterprise establish its unit, build and begin operations while it obtains regular approvals within the prescribed period.

How long does it take to get a CIPA?

Three working days for enterprises in approved industrial parks and 30 days for those outside. If the committee does not decide in time, approval is deemed granted.

Do food businesses still need a separate municipal trade licence?

No. A valid registration or licence under the Food Safety and Standards Act, 2006 is enough for the same food business activity and premises.

Can businesses be inspected after getting a CIPA?

Routine inspections are barred for three years from the grant of the CIPA, but inspections can still happen for serious complaints under Sections 13 and 14 of the Act.

Conclusion

The J&K Ease of Doing Business Act, 2026 and its three implementing orders replace multiple permission-based procedures with a time-bound, simplified system, while keeping necessary safeguards. If implemented well, it could make J&K a more attractive destination for new enterprises and investment.
