Domicile and Land
From State Subject to domicile
- Article 35A ended with C.O. 272, so the State Subject / Permanent Resident Certificate system ended.
- The J&K Grant of Domicile Certificate (Procedure) Rules, 2020 (issued 31 March 2020, amended within days) define a domicile as a person who:
- has lived in J&K for 15 years, or
- has studied for 7 years and appeared in Class 10 or 12 there, or
- is registered as a migrant with the Relief and Rehabilitation Commissioner (Migrants), or
- is a child of specified Central employees who served in J&K (10 years).
- Domicile protects jobs (after the amendment, all posts of the UT). The tehsildar issues the certificate.
Land
- Orders of October 2020 amended J&K's land laws so that any Indian citizen can buy non-agricultural land in J&K. Agricultural land remains protected for agriculturists.
