The Legislative Assembly of J&K

Sections 13 to 52 make the Assembly. Section 13 applies Article 239A (the Article for Puducherry) to J&K, giving it a Legislative Assembly and Council of Ministers.

Strength of the Assembly

• The 24 seats reserved for areas under Pakistan's occupation stay vacant and are not counted for the House's strength or its majority.
• Seats reserved: SC 7 (up from 6) and ST 9 (none before), as set by the 2023 amendment after delimitation.

Nominated members

The LG may nominate members who are not elected:

So the LG may nominate up to 5 members, taking the House to 95 and the majority mark from 46 to 48.

• A Kashmiri migrant means a person who left the Kashmir Valley or another part of J&K after 1 November 1989 and is registered with the Relief Commissioner (the law also covers some unregistered persons).
• A displaced person from PoK means a person who left or was displaced from PoK (in 1947 to 48, 1965 or 1971) because of civil disturbances or fear of them, and who lives outside PoK, along with their successors.

Rules of the House

• Qualification: Indian citizen, at least 25 years (Section 16).
• Term: 5 years from the first sitting, extended by up to 1 year at a time during a national Emergency (Section 17). (Before 2019 the term was 6 years.)
• Sessions: no more than 6 months between two sittings (Section 18).
• Speaker and Deputy Speaker: elected by the House; removed by a majority of all members after 14 days' notice (Section 19).
• Quorum: 10 members or one-tenth of the total, whichever is greater (Section 25).
• Anti-defection: the Tenth Schedule applies (Section 28). Disqualification disputes are decided by the LG after the Election Commission's opinion (Section 27).
• Languages: the Assembly may adopt official languages by law. Business is done in them, Hindi or English; the English text of Bills and Acts is authoritative (Sections 47 and 48).
• Legislative Council: abolished from the appointed day (Section 57). It had 36 members, and Bills pending in it lapsed.
