Services (Part XIII, Sections 88 to 93)

  • All India Services (Section 88): at first, IAS, IPS and IFS officers of the J&K cadre continued in that cadre. The J&K Reorganisation (Amendment) Act, 2021 merged the J&K cadre into the AGMUT cadre (Arunachal Pradesh, Goa, Mizoram and Union Territories), so officers from other UTs can serve in J&K and Ladakh. The reason given was a shortage of All India Service officers. The Bill replaced a January 2021 Ordinance and was passed in February 2021.
  • Other services (Section 89): serving State employees continued provisionally and were allotted between the two UTs on the basis of their options.
  • Public Service Commission (Section 93): the J&K Public Service Commission continues for the UT of J&K. Ladakh has no PSC of its own (its groups demand one).

Assets, liabilities and corporations

  • Section 84: assets and liabilities of the old State are shared between the two UTs on the recommendation of a Central committee, within 12 months of the appointed day.
  • Section 85: the Centre may set up Advisory Committees within 90 days for corporations, electricity and water, and the J&K State Financial Corporation. Each reports to the LG within 6 months, and the LG must act within 30 days.
  • Sections 86 and 87: road transport permits stay valid, and income-tax losses and gains of transferred bodies are apportioned.
